These Terms of Service (“Terms”) govern your access to and use of the Whitehat Webinars website located at https://www.whitehatwebinars.com/ and any related webinar services, continuing education offerings, recordings, communications, and content (collectively, the “Services”).

By accessing or using our Services, registering for a webinar, or submitting information through our website, you agree to be bound by these Terms. If you do not agree, you should not use the Services.

1. Eligibility

The content presented during webinars:

  • Should not be relied upon as a substitute for independent professional judgment.

While we strive for accuracy, we do not guarantee that webinar content is complete, accurate, current, or error-free.

3. Webinar Registration and Accounts

To access certain Services, you may be required to register and provide personal information.

We reserve the right to refuse registration, suspend access, or terminate accounts at our discretion.

4. Continuing Education Credits

Certain webinars may qualify for continuing education (“CE”) credit through third-party accrediting organizations.

Whitehat:

  • Does not guarantee eligibility for CE credit;

  • May require attendance verification, evaluations, or participation requirements;

  • Reserves the right to deny or revoke CE credit for incomplete participation or inaccurate submissions.

Participants are responsible for verifying whether credits are accepted by their licensing or certifying body.

5. Webinar Recordings

Whitehat webinars may be recorded, including audio, video, chat interactions, questions, and presentation materials.

By participating in a webinar, you consent to:

  • Recording of the session;

  • Use of your submitted questions, comments, or interactions in recordings or promotional materials;

  • Distribution of recordings to attendees or future viewers.

If you do not wish to be recorded, you should refrain from participating verbally or visually during live sessions.

6. Intellectual Property

All content available through the Services, including:

  • Webinar recordings,

  • Presentation slides,

  • Logos,

  • Graphics,

  • Text,

  • Educational materials,

  • Website design,

  • Branding,

is owned by Whitehat or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may:

  • Access content for personal, non-commercial educational use only.

You may not:

  • Reproduce,

  • Redistribute,

  • Sell,

  • Modify,

  • Publicly display,

  • Republish,

  • Create derivative works from,

any content without prior written permission.

7. Acceptable Use

You agree not to:

  • Use the Services unlawfully;

  • Interfere with or disrupt the Services;

  • Attempt unauthorized access to systems or accounts;

  • Share access credentials;

  • Upload malicious software or harmful content;

  • Harass presenters, sponsors, attendees, or staff;

By registering for sponsored webinars, you acknowledge that:

  • Sponsors may contact you regarding products, services, or educational offerings;

  • Whitehat is not responsible for sponsor communications, products, or services.

  • Practices,

  • Products, or services.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHITEHAT DISCLAIMS ALL WARRANTIES, INCLUDING:

  • FITNESS FOR A PARTICULAR PURPOSE,

  • NON-INFRINGEMENT,

  • ACCURACY,

  • RELIABILITY,

  • AVAILABILITY.

We do not guarantee uninterrupted or error-free operation of the Services.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHITEHAT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

  • LOSS OF DATA,

  • LOSS OF PROFITS,

  • BUSINESS INTERRUPTION,

  • LOSS OF PROFESSIONAL CREDITS,

  • OR OTHER INTANGIBLE LOSSES

ARISING OUT OF OR RELATED TO THE USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICES SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

13. Indemnification

You agree to indemnify and hold harmless Whitehat, its officers, employees, affiliates, presenters, sponsors, and partners from claims, damages, liabilities, and expenses arising from:

  • Your use of the Services;

  • Your violation of these Terms;

  • Your infringement of third-party rights.

14. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if:

  • You violate these Terms;

  • Your conduct may harm Whitehat or others;

  • We discontinue the Services.

Sections intended to survive termination shall remain in effect.

15. Modifications to Services or Terms

We reserve the right to:

  • Modify or discontinue the Services;

  • Update these Terms at any time.

Updated Terms become effective upon posting. Continued use of the Services constitutes acceptance of revised Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to conflict of law principles.

Any disputes arising from these Terms or the Services shall be resolved exclusively in the state or federal courts located in Virginia.
